Responding to Immediate Jeopardy (IJ) Citations

Immediate Jeopardy is the most serious level of deficiency. Your response timeline is critical — typically 23 calendar days before termination proceedings begin.

Critical Timeline: An IJ citation means CMS has determined that the deficiency has caused, or is likely to cause, serious injury, harm, impairment, or death to a resident. You must remove the IJ situation immediately and submit a credible allegation of compliance.

Step 1: Immediately Remove the Jeopardy

Take whatever actions are necessary to remove the immediate threat to resident safety. This must happen before anything else — before paperwork, before plans, before meetings. Document every action with timestamps.

Step 2: Assemble Your Response Team

Gather your Administrator, Director of Nursing, Medical Director, department heads, and legal counsel (if available). Assign clear roles for abatement, documentation, and communication.

Step 3: Draft Your Allegation of Compliance

Your Allegation of Compliance (AoC) must demonstrate that the IJ has been removed. It should include: what actions were taken, when they were taken, who took them, and how you verified the jeopardy was removed.

Step 4: Assemble Supporting Evidence

Gather documentation that supports your allegation: updated care plans, staff reassignments, environmental modifications, training records, policy revisions, photographic evidence, and any third-party assessments.

Step 5: Submit and Prepare for Revisit

Submit your AoC to the state survey agency. Prepare for a revisit survey where surveyors will verify that the IJ has been removed. Continue all corrective measures and monitoring until the revisit confirms removal.
